Due Diligence Basics for Foreign Buyers
Due diligence is the discipline of confirming what is, before believing what is said.
Due diligence is not a single document. It is a short, sequenced set of checks that confirms the property, the seller, and the transaction match what the buyer has been told.
The minimum checklist
- **Property**: title chain, lien certificate, cadastral match, predial standing, water standing, HOA standing.
- **Seller**: identity, capacity to sell, marital status (which can affect community property), power of attorney validity if used.
- **Permits**: construction license, occupancy, environmental, HOA approval for past modifications.
- **Money path**: regulated escrow, written instructions, no third-party detours.
- **Trust**: bank selection, fee schedule in writing, SRE permit timeline.
A useful frame
For each item, ask three questions:
1. What document confirms this?
2. Who issued it and when?
3. What would I expect to see if something were wrong?
If any answer is "the seller told me," it is not due diligence yet.
